What is Statutory Building Compliance?

Statutory building compliance refers to the legal obligations placed on building owners, occupiers and facilities managers to ensure their premises are safe, maintained and operated in accordance with UK law.

Failure to comply is not simply an administrative oversight — it can result in unlimited fines, criminal prosecution, invalidated insurance and most critically, serious harm to the people who use your building.

Compliance obligations flow from a hierarchy of UK legislation including primary acts of parliament, secondary statutory instruments, approved codes of practice (ACOPs) and British Standards. Understanding this hierarchy is the foundation of any effective compliance programme.

A Four Seasons Healthcare care home was fined £600,000 after a resident died from Legionnaires disease. A Nottingham lettings director was fined £150,000 and given a suspended prison sentence for fire safety breaches. These are not isolated cases — they happen every year across the UK.

Who is Responsible?

Responsibility for statutory compliance sits with what legislation calls the duty holder. Depending on the specific legislation this may be:

  • The building owner
  • The employer or person in control of the premises
  • The Responsible Person (under the Fire Safety Order)
  • The Principal Accountable Person (under the Building Safety Act 2022)
  • The facilities manager acting on behalf of the above

In practice, for most SME commercial premises, the business owner or managing director carries ultimate legal responsibility — even if day-to-day compliance tasks are delegated to a facilities manager or external contractor.

How UK Compliance Legislation Works

Understanding the structure of UK compliance legislation helps you prioritise correctly. Legislation flows from the top down:

1

Primary Legislation

Acts of Parliament e.g. Health and Safety at Work Act 1974

2

Secondary Legislation

Statutory Instruments e.g. Electricity at Work Regulations 1989

3

ACOPs & Guidance

Approved Codes of Practice e.g. L8 ACOP for Legionella

4

British Standards

Industry best practice e.g. BS7671 for electrical installations
